In my employment, one law that covers employments is the Working Time Regulation 1998. As by law when you have worked 6 hours, you are legally allowed 20 minutes rest, that you are entitled to have 11 hours rest between shifts, one day off a week, 5. 6 weeks off paid a year, and a limit of 48 hours a week, however the worker can do more if it’s their own choice. This regulations applies to all work whether its full time, part time. This regulation governs the hours any works as to find the pattern of work, the holidays and the maximum hours worked weekly.This regulation is there to make sure that the workers of a business or company can have a work life balance. Another act that protect people in work is the Equality Act 2010, which basically means that everyone is treated equally no matter what within the workplace and in the wider society.
As there is the Human Rights Act 1998 which gives everyone the right to a life, prohibition to forced labour, freedom of expression, the right to marry etc.The Employment Rights Legislations 1996 has many sections included in it, such as the right to statutory pay when on maternity, paternity leave where you can take 26 weeks leave and then take additional maternity leave for another 26 weeks providing that there is proof of the pregnancy. Also there is employment status which has to match the employment law, so their status help determine their rights and their employers responsibilities such has having statutory sick pay.These all come under continuous employment. Your employer needs to make a contract with the correct type as it gives the employee an employment status which helps with tax purposes and hours to work a month.
Also under this legislation is redundancy as my law you need to have a notice period, a talk with your employer, time off to find a new job and redundancy pay. Task 2 You can get advice about the employments rights and responsibilities by either the internet, direct gov. o. uk or you can ring up citizens advice bureau, you could go to your employee and they would have a company policies and they would show you your rights and responsibilities, plus you can get your employment contract as everything is stated in there, plus you can ring ACAS and if there is a union you belong to you can go to them and they can help you out. Task 4 On my wage slip there is the name of the employer so that the hours worked can go to the correct person.Also as a wage slip is confidential, the employers name and address is on the top of the wage slip therefore no one else can open it.
The employers name is on their also to stop confusion between everyone’s payslip as every employee works different hours and are on different pay rates due to the qualification and ages of the employee. The employee number is on there so on the date base of the company they can get your record of your address, emergency contact details and the hours worked, or the days of holidays or the days of sick taken.This number is individual to everyone so the records can’t get mixed up. The tax code is on there so you can see the amount of money you are being taxed a month and to make sure they are taking the right amount of tax due to the fact that you could be paying not enough tax therefore there could be asked to repay the tax owed or you could be paying too much tax so you could get a tax rebate (which means the tax overtaken is given back to you by a cheque sent in the post).The national insurance number is on you payslip as that determines your identity to the government so they can see your age, your tax code etc it makes the process of taking tax easier and quicker. Your Net Pay to date is on there as it allows you to see how much money you have earned with that company since you have been working there in the current tax year. Pay before deductions is often called Gross Pay, that is on there so you can see how much money you have been paid a month without the tax, or any other things like uniform costs or your national insurance taken off.
If you are in a pension scheme there would be deductions for a pension, so you can save for your future. For example in my work place there is a new pension scheme where you can pay however much a month out of your wages towards your pension and your employer has to pay the same amount. Finally the last thing on your wage slip is the amount of pay you actually receive (after deductions) this allows you to see how much you have been paid into your bank account after your national insurance, tax and any extras such as uniform costs or pension schemes has been taken out of your wages.Task 5 The company’s grievance procedure states that if there is grievance you needed to contact the line manager as soon as possible. Then you would be asked to put the grievance in writing therefore to make sure there is no ambiguities over the mater.
Then the line manager would respond verbally as soon as possible within 7 working days. If you are not happy with the line manager or you are still dissatisfied you can ask for the line manager to put it in writing and you can formally yourself write to the Chief Executive who will look at your grievance.The Chief Executive would meet with you as soon as possible normally within 10 working days. At the end of that the decision would be put in writing therefore the Chief Executive’s decision will be final. That’s the formal procedure. There is some exceptions such as with pay (tax, national insurance) would need to be discussed with your payroll provider. If you need representation you have the right to bring a work colleague or if you are a part of a union you can get them involved to any grievance official meeting.
Task 6 My employer keeps personal information about me. Which is my full name, my marital status, gender, date of birth, home address, home phone number, mobile number, national insurance code, emergency contact details such as their name, address and phone number, education and qualifications, employment history, any details of disability, contact between the employer and employee and any disciplinary action.The employer needs to know this information so they can keep it on the data base.
Which is pass worded on the computer and only seniors, administration, the manager and the owner of the home has access to this information in case there is an emergency involving the employer so the family can be told straight the way, or in case anything happens at work that the employees family need to be told about..The personal information such as full name, my marital status, gender, date of birth, home address, home phone number, mobile number, national insurance code is needed for the employment records so there is no confusion between employee’s, in case they need to get hold of the person for cover for a shift, there is a hospital appointment for the resident or there is a meeting needed or even for additional courses. The employer needs to be able to get hold of the employer.As for needing the education details this is to see if the employee is qualified for the job or to see if the employer needs any additional courses or to see if there is courses to take that they haven’t already done. The employment history is so they can find out what you were like at your old work place by asking them to provide a reference, or to see the tax code for you at that time. Plus to see if ever you have had any disciplinary action that they would need especially since my job role is in care.
The contract between the employee and employer therefore you can see the amount of hours contracted so therefore how many hours a week they need to give you as if you don’t have enough, you could take them court as its broken your employment contract. Task 7 My job role is a care assistant. To give care to the elderly who needs/requires assistance with bathing, getting dressed, making sure they are eating and drinking the right amount, to keep the residents happy, to do anything I can to make them happy and as comfortable as possible, to take the residents to the toilet and making sure they are dry to prevent sores etc.My responsibilities are to keep the residents safe and happy and clean. The running of the residential home needs carers as they provide all the care needs that are required, without the carers the residents have no one to take care of them and fulfil all of their needs. Task 8 In my job role we work with many different professionals and companies. One is the Chiropodist who’s role is take care of the residents feet to check if there is any abnormities such as corns on their feet and cure it, to cut their toe nails etc.
We work alongside them as if we notice anything wrong with the residents walking or they appear to have pain in their feet, we can ask them to have a look at their feet. We also work with Options as if they wear glasses we have to monitor the glasses, see if they are rubbing on the residents and make sure that they don’t get lost or broken. Vision Call who we get some of the glasses for the residents. Their roles is to test their eye sight and get the glasses for them.
We work with a company called Clarks and Partner who we have different wheelchairs from for the residents and we monitor how the wheelchairs are treated, when they are in need of a service or if they residents aren’t comfortable in the chairs we need to call them and ask them to replace a pressure cushion or a part of the chair that is broken. We also work with the dentists whose role is to provide the residents with a check-up whether they are their own teeth or dentures, to provide teeth that the residents are able to use and are comfortable.However we also have to make sure the dentures fit correctly and the residents aren’t in any pain with the dentures or with their own teeth. We often work with doctors who come out to the residents when they are ill and if the residents are unable to tell them the problem, we need to act as an advocate for them to tell them what the problem is and to listen to the doctors and make sure the residents are healthy. Plus we work with the district nurse who comes in to provide care to the residents such as dressing a wound, checking and monitoring pressure sores and providing dressings for bedsore or tears in the skin.We have to work alongside them, follow instructions if the residents need to go on bed rest etc, plus to monitor any bedsores the residents could get, to check the residents to see if they have any sores that need to be dressed. Plus we need to check the residents skin in case there is a skin tear that needs to be seen to by the district nurse.
Task 9 Within my care setting as a career, you could progress to be a senior within a residential home, the deputy manager, an administrator or even go to be a manager with a lot of hard work this could be made possible.In the care sector you could progress to go into the hospitals as a health care assistant, a ward administrator, an assistant to nurses, doctors anything really as with being a carer you are a part of the care sector and you are then able to work your way up to being anything you want as by taking courses or through getting experience and going into care jobs and working your way up in a job. As this is more of a satisfying way of working hard for what you get and get more self-independence for a job.
